The protection of the privacy of our customers/users is assumed by Hope Care SA, hereinafter referred to as Hope Care, as a task of primary responsibility.

In this sense, this privacy policy is intended to guarantee all our customers/users a complete security in the use of our website, describing who we are, for what purposes we can use your data, how we treat it, with whom we share it, for how long we keep it, as well as how to contact us and exercise your rights.

Hope Care processes and stores personal data, respecting the best practices in the field of security and protection of personal data, having taken the necessary technical and organisational measures in order to comply with the General Data Protection Regulation (Regulation (EU) 2016/679), which is a legislative act directly binding on natural and legal persons who, being resident or not in the EU, they treat data of citizens of the European Union and which aims to ensure that the processing of personal data is lawful, fair, transparent and limited to the authorized purposes, and also by Law 58/2019 of 8/8, which ensures the implementation, in the national legal order, of the General Data Protection Regulation.

The data requested in the forms are mandatory collection, under penalty of not being able to provide the service.

The privacy statement is under the responsibility of Hope Care S.A. based in the Technological Park of Óbidos, Rua da Criatividade, Edifícios Centrais, 2510-216 Óbidos, being considered responsible for the processing of data, for the purposes of the GDPR, and will determine the purpose and means of processing personal data submitted and collected online.

By accepting this Privacy Policy, the Customer/User is informed and provides his/her free, specific and unequivocal consent to the processing of his/her personal data, provided on our website, together with browsing data and other data, provided to Hope Care in the future.

You should carefully read this Privacy Policy, which has been written clearly and simply, to facilitate understanding, so that you can, of your own free will, decide whether you wish to provide your personal data to Hope Care.

What personal data do we process?

Hope Care collects and processs the following personal data:

– Identification data: first name, surname, nationality, age, gender, weight, height, ethnicity, identification document data (Civil Id number; Tax Identification number; date of Birth, and photograph).

– Contact details: email address, phone number, personal address.

– Navigation data: serial number of your personal digital assistant (i.e., iPhone, iPod Touch, iPad or android device).

What is the processing of personal data?

The processing of personal data consists of an operation or set of operations, carried out on personal data or sets of personal data, by automated means, or not, including the collection of, registration, organization, structuring, retention, adaptation, retrieval, consultation, use, disclosure, dissemination, comparison, interconnection, limitation, payment or destruction.

As a rule, Personal Data is required to create an account protected by username and password. To do this, you must provide your email address as your username and a password of your choice. Your email address can be used to send you Electronic Communications when needed.

Our data protection policy ensures that the data is:
  1. Lawful, fair and transparent treatment of the data subject (‘lawfulness, loyalty and transparency’);
  2. Collected for specific, explicit and legitimate purposes and cannot be treated later in a manner incompatible with those purposes;
  3. Appropriate, relevant and limited to what is necessary in relation to the purposes for which they are processed;
  4. Accurate and up to date whenever necessary; appropriate measures are being taken to make inaccurate data, taking into account the purposes for which they are processed, be erased or rectified without delay;
  5. Preserved in a way that allows the identification of data subjects only for the period necessary for the purposes for which they are processed;
  6. Treated in a manner that ensures their safety, including protection against their unauthorised or unlawful treatment and against their accidental loss, destruction or damage, by taking appropriate technical or organisational measures;
Purpose / Justification of the Processing of Personal Data.

In general, the personal data collected, are based and are intended for the management of the contractual relationship, the provision of the contracted services, the adequacy of the services to the needs and interests of the Client/ User, in particular for the use of our software and applications.

Your Personal Information to use the Software will be asked to create an account protected by username and password. To do this, you must provide your email address as your username and a password of your choice. Your email address can be used to send you Electronic Communications when needed. In addition, while using the Software, you may be asked to voluntarily provide some personal information (such as gender, weight, height, date of birth, ethnicity and other data required by the software to calculate health risk indicators and color charts) for purposes such as the use of some special features of the Software.

The Software is a tool that uses tables, graphs and mathematical calculations to allow you to track your data entered in the Software over time and that allows you to compare your data with the standardized values and values of the general population. The Software is for your personal, educational, informative, entertainment and convenience only use.

Use of Bluetooth Devices – The Software can be connected via Bluetooth technology to health parameter measurement devices. Manufacturers of these devices have chosen to use Bluetooth LE (low energy) communication as a mean of providing a “real-time” experience for users, enabling immediate data recovery from their devices. The Software does not use Bluetooth for any other purpose. If the customer/user does not wish to have their personal information transmitted via Bluetooth, they can disable Bluetooth on their smartphone or similar device in the settings app for that device, or they may simply not turn on (or disconnect if you have already connected) devices that require Bluetooth on the eHealth page of the Software.

Use of location data – At the user’s discretion, the Software may be connected by Bluetooth technology to health measurement devices and for better connectivity and use it is necessary to enable Location. The Software does not use location data for any purpose other than to connect Bluetooth medical devices. No location data is sent to hope care servers. If you don’t want to turn on your Location, you can turn off Location on your smartphone or similar device in the settings app for that device. Turning off Location, this will condition the use of multiple Bluetooth medical devices.

Hope Care may use your personal information to contact you and at the correspondence level, to answer your questions, to monitor the communications exchanged, to execute your requests for backups of personal information, to assist in the management of your weight and related health information, to generate global statistics for software users, to help Hope Care develop new Software services and features that meet your needs, to improve the Software, to provide you with the requested Electronic Communications, or that we think may be of interest to you.

In addition, personal data may also be processed for the purposes of compliance with legal obligations and for the purpose of investigating, detaining and re-investigating serious crimes.

In any other use, not defined in the preceding paragraphs, Hope Care guarantees the prior consent of the holder of the personal data.

Retention Period:

The period during which personal data is stored varies according to the purpose for which the information is processed.

In fact, there are legal requirements that require you to retain the data for a minimum period of time. Hope Care may store and process your personal data for a period of time during which your account remains active and for a period of twelve months after you delete your account. After this time Hope Care will delete your stored personal information. Hope Care stores this information in offices located in Portugal or elsewhere in Amsterdam, and its server locations must be located elsewhere as part of a cloud computing-based architecture with the server’s ability to be rented from a third-party vendor.

Adulthood:

By accepting this privacy policy, the Customer/User, you warrant that you are 18 years of age or older.

The Client/User also warrants that the data provided are true, accurate, complete and current. For these purposes, the user is responsible for the veracity of all data disclosed and must keep the information provided up to date, so that they reflect his current situation.

Sharing personal data

Hope Care may transfer or disclose your personal information to its employees, agents and consultants if disclosure allows these parties to conduct business, technical or professional support functions for Hope Care.

Such parties shall be subject to the same obligations as Hope Care under this Policy.

Hope Care may be involved in the sale or transfer of some or all of its assets or other transactions. As part of this transaction, Hope Care may disclose your personal information to the acquisition organization or other organization involved in the transaction to the extent permitted by law but will require such organization to agree to protect the privacy of your information in full compliance with this Privacy Policy.

Hope Care warrants that it does not intend to transfer data to third countries to the General Data Protection Regulation and if it does, it will ask you for consent.

Data Processing security

Hope Care is committed to ensuring the protection of the security of personal data made available to it, having approved and implemented strict rules in this area. Compliance with these rules is an obligation for all those who legally access them.

Bearing in mind the concern and commitment that Hope Care, reveals in the defense of personal data, several security measures of a technical and organizational nature have been adopted, in order to protect the personal data made available to it against its dissemination, loss, misuse, alteration, treatment or unauthorized access, as well as against any other form of unlawful processing.

Hope Care employs “https” security measures appropriate to the sensitivity of information.

However, due to the nature of the Internet and Internet technologies, security and privacy risks cannot be completely eliminated, and Hope Care cannot fully guarantee that your personal information will not be accessed in ways not covered by this Policy.

Access and rectification or deletion of personal data

As the data subject the Client/User, they have the right to request access to the data concerning him or her, to request to rectify them and to delete them. It may also limit the processing given to the data, as well as to be owed it and also require the portability of the data.

You may do so, directly or upon written request, addressed to the respective Controller, through the contacts made available for this purpose in this document.

You can also file a complaint with the CNPD – National Data Protection Commission, located at Av. D. Carlos I, 134 – 1st 1200-651 Lisboa, with the phone (+351) 213928400, whenever you understand that your rights are being violated.

Right of access

The holder of the personal data has the right to obtain from Hope Care, confirmation that the data concerning him or her are subject to processing and, where appropriate, to access his personal data and access the information provided for by law.

Right of rectification

The holder of the personal data has the right to obtain from Hope Care, without undue delay, the rectification of the inaccurate or incomplete data concerning him.

Right to the payment of data (“right to be forgotten”)

The holder of the personal data has the right to obtain from Hope Care the erasure of his/her data without undue delay, and the data is obliged to erase the personal data without undue delay, when one of the following reasons applies:

(a) personal data are no longer necessary for the purpose of collecting or processing them;

(b) the data subject has withdrawn his consent to the processing of data (where the processing is based on consent) and there is no other basis for such processing;

(c) the holder opposes the processing and there are no prevailing legitimate interests justifying the processing;

Right to limitation of treatment

The data subject has the right to obtain from Hope Care the limitation of the processing, if one of the following applies, inter alia:

(a) to challenge the accuracy of the personal data for a period of time enabling Hope Care to verify its accuracy;

(b) the processing of data is lawful, and the data subject opposes the erasure of personal data and requests, on the other hand, the limitation of its use;

(c) Hope Care no longer needs personal data for processing purposes, but such data are required by the holder for the purposes of making, exercising or defending a right in a judicial proceeding;

(d) if it has opposed the processing, until it is found that the legitimate reasons of the controller prevail over those of the data subject.

Right of data portability

If the processing depends on the consent of the data subject and that consent has been provided by automated means, the data subject has the right to receive the personal data concerning him and which he has provided to Hope Care in a structured, commonly used and machine-readable format.

Right of opposition

Where the processing of data is carried out for 1) effect of the legitimate interests pursued by Hope Care; or 2) the processing of data is carried out for the purposes of direct marketing or 3) definition of profiles, you can also, at any time, owe the processing of your personal data.

Marketing emails

Data processing officers have permission, after explicit consent, to send marketing emails to users of the site. At any time, the user may cancel the consent via the link, existing for this purpose, in each email sent.

Changes to this policy

This policy may be updated from time to time, for example due to changes to the relevant legislation. If any material changes are conducted, customers will be notified by email or by notification on the website.
